Privacy Policy

1. Preamble

This Privacy Policy applies to this website. Its purpose is to explain to users of the site:

  • How their personal data is collected and processed – all data that may identify a user shall be deemed "personal data";
  • Users' rights relating to this data;
  • Who is responsible for the processing of the personal data that is collected and processed (i.e. the data controller);
  • Who this data is transmitted to;
  • The site's cookie policy.

Definitions

  • User: any internet user logging into and/or using the above-mentioned site.
  • Personal data: all information relating to an identified or identifiable person (Swiss Federal Act on Data Protection, Section 1 Art. 3).
  • Processing: any operation with personal data, irrespective of the means applied and the procedure, and in particular the collection, registration, storage, use, revision, disclosure, archiving, deletion, or destruction of data.
  • The terms "personal data", "data subject", "processor", "processing" and "sensitive data" have the meanings defined by the Swiss Federal Act on Data Protection.

2. Legal information

The site is published by the International Organisation of Employers (IOE), and has its headquarters at Avenue Louis-Casaï, 71, CH-1216 Geneva.

The site is hosted by Mittwald CM Service GmbH & Co. KG.

3. Protection of personal data

Pursuant to the Swiss Federal Act on Data Protection, IOE, in its capacity as controller of the data file, i.e. data controller, informs the user of its processing of the latter's personal data.

The user understands and accepts that any information they disclose via the forms available, where applicable, on the site or via email to the addresses indicated on the site is intended for authorised IOE staff for the purposes of administrative and commercial management.

3.1. Parties responsible for the collection of personal data

For the personal data collected in connection with the creation of the user's personal account and their browsing of the site, the party responsible for processing of the personal data (i.e. data controller) is IOE.

IOE, as controller of the data it collects, undertakes to comply with the framework of prevailing legal provisions. In particular, the customer is responsible for compiling the purposes of its data processing, providing its prospects and customers, as of the collection of their consent, with comprehensive information on the processing of their personal data, and maintaining a processing register that is consistent with reality. Whenever IOE processes personal data, IOE takes all reasonable measures to ensure the correctness of the personal data and its relevance to the purposes for which it is being processed by IOE.

3.2. Purpose of the collected data

www.ioe-emp.org may process all or some of the data to:

  • enable browsing on the site and the management and traceability of the services ordered by the user: login and usage data for the site, and so on;
  • prevent and combat IT fraud (spam mails, hacking, etc.): IT hardware used for browsing, IP address and (hashed) password;
  • improve browsing on the site: login and usage data;
  • run communication campaigns (by mobile text message and email): telephone number and email address.

www.ioe-emp.org does not market your personal data which is therefore used only when required or for statistical and analytical purposes.

3.3. Rights of access, rectification and objection

Pursuant to the prevailing European Union (EU) legislation, users of www.ioe-emp.org have the following rights:

  • right to access, rectify, update and complete users' data, and to block or erase (delete) users' personal data, if it is incorrect, incomplete, ambiguous, or out of date, or its collection, use, disclosure, or storage is not allowed;
  • right to withdraw consent at any time;
  • right to restrict the processing of users' data;
  • right to object to the processing of users' data;
  • right to the portability of data that users have supplied, if this data is subject to automated processing based on their consent or a contract;
  • right to decide on the fate of users' data after their death and to choose to which third party previously designated by a now deceased user www.ioe-emp.org will have to communicate (or not, as the case may be) the deceased user's data.

If the user wishes to find out about IOE's use of their personal data, request its rectification, or object to its processing, the user can contact IOE in writing at the following address: marinkovic(at)ioe-emp.com.

In such a case, the user shall indicate the personal data that they would like IOE to correct, update or delete, by identifying themselves precisely with a copy of an identity document (identity card or passport).

Requests for deletion of personal data will be subject to the obligations legally incumbent on www.ioe-emp.org, in particular with regard to the storage or archiving of documents. Users of www.ioe-emp.org may file a complaint with the competent supervisory authorities.

We have 30 days from receipt of your request to respond. We may restrict, defer or even refuse your right of access, rectification or erasure (deletion). In such a case, our response will be reasoned, explaining to you the reasons for our refusal of the deferral or restriction. Finally, once the reasons and/or interests that justified this refusal, deferral or restriction no longer apply, we undertake to provide you with the requested information unless this is impossible or only possible with disproportionate inconvenience or expense

3.4. Non-disclosure of personal data

IOE is not allowed to process or host the collected information on its customers or transfer it to a country outside the EU or recognised as "unsuitable" without informing the customer in advance accordingly. However, IOE is still free to choose its technical and commercial subcontractors/processors on condition that the latter provide sufficient safeguards in terms of the requirements of the EU's General Data Protection Regulation and the Swiss Federal Act on Data Protection.

IOE undertakes to take all the precautions required to maintain the security of the information and in particular to ensure that it is not disclosed to unauthorised persons. However, if an incident compromising the integrity or confidentiality of the customer's information is brought to the attention of IOE, the latter must inform the customer as soon as possible and notify them of the corrective measures taken.

3.5. Data storage

Data is only stored for as long as is necessary for the purposes of processing or under a legal basis to which we are subject.

3.5.1. For internet users in Switzerland

While the retention period in principle is 10 years, the retention periods for data are in line with the recommendations of the Federal Data Protection and Information Commissioner (FDPIC) and/or our obligations under legislation, as follows:

  • for life for official documents, e.g. official family documents, passport, family record book, old-age and survivors' insurance (OASI) card, qualification certificates, employment references and property deeds
  • five years for cantonal taxes, public insurance policies (e.g. mandatory insurance, OASI), rent payments, payslips, child maintenance, bills of doctors, notaries, lawyers, tradespeople, etc.;
  • three years for any fines;
  • two years for insurance (e.g. private, supplementary or home insurance).
3.5.2. For internet users in the EU

Personal data is stored pursuant to the provisions of Simplified Standard No. 48 of the Commission nationale de l'informatique et des libertés (CNIL), the French Data Protection Authority, concerning the automated processing of personal data relating to customer and prospect management.

The data retention periods are in line with CNIL recommendations and/or legal obligations:

  • three years after the last commercial contact for customer account data;
  • one year for website login data;
  • 13 months for cookies;
  • five years for bills/invoices;
  • storage until the customer's deletion request in the case of identification data.

At the end of the retention period, the data is anonymised and/or destroyed, as the case may be.

3.5.3. For online applicants

The application particulars will be kept while they are being processed by the authorised parties. The transmitted documents as well as the copies thereof will be deleted immediately upon rejection of the application unless you grant your consent to the application being stored with a view to consideration for another position that might fall vacant subsequently.

4. Use of cookie files

The site uses cookies. A cookie is a file which is stored by the site on the user's hard drive and contains information on the user's browsing habits.

4.1. Framework for the use of cookies

www.ioe-emp.org may process information concerning the user's visit to the site, such as the pages viewed and the searches performed. This information enables IOE to improve the content of the site and the user's browsing experience.

As regards cookies facilitating navigation and/or the provision of services offered by the site, the user can configure their browser settings to allow them to decide whether or not they wish to accept such cookies, enabling cookies to be saved on the device, or, otherwise, reject either all of them or some depending on the issuer of such cookies. The user can also configure their browser software in such a way that they are periodically given the option to accept cookies or reject them, before a cookie can be saved on their device. IOE informs the user that, in the latter case, their browser software may not be fully functional.

If the user rejects the storage of cookies on their device or in their browser, or if the user deletes those stored there, the user is informed that there may be limitations on their browsing and experience on the site. This may also be the case when www.ioe-emp.org or one of its service providers cannot recognise, for technical compatibility purposes, the type of browser used by the device, the language and display settings or the country where the device appears to have its internet connection.

Where relevant, IOE rejects any liability for any consequences associated with the reduced functionality of the site and any services offered resulting from (i) the user's rejection of cookies; (ii) the inability to store or refer to the cookies required for them to work properly because of the choice made by the user. Each browser has its own settings for the management of cookies and user preferences. These settings are set out in the browser's Help menu, where information can be found on how the user can edit their cookie preferences.

The user can choose to set and edit their cookie preferences at any time. IOE may also use the services of external service providers to help it collect and process the information described in this section.

Finally, if you click on the icons for the social media providers Twitter, Facebook, and LinkedIn on the site www.ioe-emp.org and have accepted the storage of cookies, as you continue to browse the website www.ioe-emp.org, Twitter, Facebook, and LinkedIn may also store cookies on your devices (computer, tablet, mobile phone).

4.2. Description of the cookie files used by the site

The site publisher draws the user's attention to the fact that the following cookies are used during browsing:

  • Necessary
    These cookies are required for good functionality of our website and can't be switched off in our system.
  • Statistical cookies
    Statistical cookies, through the collection and reporting of anonymous information, help website owners to understand how visitors interact with websites. They are used by Google Analytics to collect data on the number of times a user has visited the website and the dates of their first and most recent visits.
  • Marketing
    Marketing cookies are used to track visitors across websites. 5. Liability

IOE undertakes to use all due diligence to ensure that users have access to the site at all times. However, it cannot be held liable in the event of unavailability of the site, whatever the reason for this might be.

The user of the site confirms that they have read this legal notice prior to using the website and undertakes to comply with its stipulations.

The user confirms that they have the proficiency and tools required to access and use the site, that they have checked that the IT setup used does not contain any viruses, and that it is in perfect working order.

IOE cannot guarantee the correctness and completeness of the information published on its site or that it will at all times work properly or provide total digital security.

IOE makes every effort to supply users with available and verified information and tools, but it cannot be held liable for any error, lack of availability of information and/or presence of viruses or other infections on its site.

The information provided by IOE is purely indicative. IOE cannot guarantee the correctness or completeness of the information given on the site, nor that it is up to date.

The user confirms that their use of the information and tools available on the site is solely at their own risk.

6. Intellectual property

The site taken as a whole, as well as each of its constituent elements taken independently, in particular the specific programs and developments and the contents, including data, text, still or animated images, logos, audio, graphics and files, are the exclusive property of IOE or third parties who have granted it a licence. Any total or partial representation of the site or of one of its constituent elements without the explicit authorisation of IOE is prohibited and would in particular constitute a breach of the Swiss Federal Act on Copyright and Neighbouring Rights (CopA).

The databases featured on the site are protected by the CopA, and any qualitatively or quantitatively substantial extraction or reuse of the content of the databases is subject to sanction.

The trademarks and logos featured on the site are trademarks registered by IOE or by third parties. Any reproduction, imitation or use, in whole or in part, of these distinctive marks without the explicit authorisation of IOE is strictly prohibited and renders the party concerned liable.

The other distinctive marks, in particular the company names, trade names, banners and domain names, reproduced on the site are the property of IOE or third parties and any reproduction without explicit authorisation is likely to constitute piracy for which the party concerned may be held liable.

7. Amendment

IOE reserves the right to amend the contents of this legal notice at any time and without providing any prior notification. Therefore, the user is encouraged to consult it on a regular basis.

8. Links

The access conditions and contents of any links to third-party sites are not the responsibility of IOE.

9. Applicable law and jurisdiction

This site is governed by Swiss law. Any legal action in connection with these legal notices will fall under the exclusive jurisdiction of the ordinary courts of the Republic and Canton of Geneva.

10. The user's acceptance of the Privacy Policy

By browsing on the site, the user confirms that they have read and understood this Privacy Policy and accepts its conditions, in particular regarding the collection and processing of their personal data, as well as the use of cookie files.
